Opinion: Magic Key lawsuit plus locals’ problem?

Last week, Disney Matters reported on a class-action lawsuit that Jenale Nielsen filed on her behalf, as well as Dream Key holders stating that Disney “misled and deceived its most loyal fans by artificially limiting capacity and restricting reservations” at Disneyland Park. They are claiming that the Magic Key Program, Disneyland’s revamped annual pass program, has “no blockout dates” and yet, they were denied being able to go whenever they wanted because of a lack of available reservations. Six separate allegations were filed. The judge dismissed four of those allegations but is allowing two to move forward.

“The lawsuit alleges that Nielsen purchased a $1,399 Disneyland Dream Key annual pass with no blockout dates in September 2021,” writes MacDonald. However, when she tried to make reservations to visit the Anaheim theme park on several dates in November 2021, she could not get a reservation. It says that Disney “relegated them to ‘second class’ ticket holders by artificially limiting Magic Key reservations and the number of passholders that can visit on any given day”

In the complaint, Nielsen alleges she and “thousands” of others “suffer[ed] damages in the form of lost money from the purchase price of the Dream Key passes.” It goes on to say that she “seeks, among other things, ‘an order for the restitution of all monies from the sale of the Dream Key passes … requiring Disney to pay restitution to restore all funds … The equitable relief she seeks also includes disgorgement, restitution, and orders ‘enjoining Disney from engaging in the unfair, unlawful, and deceptive business practices and false advertising complained of herein,’ ‘compelling Disney to conduct a corrective advertising campaign,’ and ‘compelling Disney to recall and destroy all misleading and deceptive advertising materials.’”
